The terms and conditions of this Policy apply to your usage of “Ignite Desk,” a job-search and hiring website for both employers and job seekers (hereafter referred to as the “Platform”).
The terms of this Policy apply to all individuals who use or access the Platform on behalf of a business, organization, government agency, or educational institution (the “Enterprise”) or in their capacity, including authorized users acting on behalf of the Enterprise, the Enterprise’s employees, or other individuals using or accessing the Platform (the “User(s)”). Anyone accepting the provisions of this Policy on behalf of an Enterprise further indicates and guarantees that they are authorized to bind that Enterprise to the Policy and that they are doing so by consenting to its terms.
The data provided on the Platform, including without restriction the quality, safety, and legality of the jobs/resumes posted, the dependability or accuracy of the job listings, and the ability of employers to offer job opportunities to candidates and/or the ability of candidates to fill job vacancies (the “User Content”), is not handled by Ignite Desk because it is never involved in any communication between Users.
Ignite Desk disclaims all warranties, express or implied, as to the accuracy, timeliness, or completeness of any User Content posted on the Platform. In addition, Ignite Desk is not responsible for any mistakes that may be made as a result of someone relying on information posted on the Platform by someone other than Ignite Desk.
Ignite Desk retains the option to delete User Content from the Platform at any time and for any reason; however, Ignite Desk is under no commitment to do so.
In no way or form shall Ignite Desk be liable for the Platform services and/or User Content failing to:
Direct or indirect responsibility for any infrastructure-related problems such as computer viruses, worms, system outages, hardware malfunctions, operating system (OS) failures, denial of service attacks delays, OS software lags, and/or other internet-based pressures that could impair the Platform’s functioning, implementation, support, or accessibility and harm Users or third parties.
Ignite Desk disclaims all responsibility for any loss, harm, delays, or failures resulting from the use of the Platform that is caused by events outside of Ignite Desk’s control, such as acts of God, alterations to the law, embargoes, wars, terrorist attacks, acts or omissions of third parties, epidemics, explosions, socioeconomic instability, natural disasters, power outages, weather conditions, hacker activity, internet problems, service providers, or any other unforeseen user or any third party.
Neither ignite desk nor any other party involved in creating, producing, or delivering the platform content shall be liable for any incidental, special, exemplary, or consequential damages, including but not limited to lost profits, loss of opportunity, loss of data, goodwill, service interruptions and others.
THIS POLICY REQUIRES THE EXCLUSIONS AND LIMITATIONS SET FORTH ABOVE IN ESSENCE.
